DEFINITIONS Unless otherwise specified, the following definitions apply to capitalized terms:
The term "Account" refers to the user-created account created on the Site in accordance with the terms of the Agreement, registered with Shark Contractors , and authorized by Shark Contractors .
The Terms and Conditions, Privacy Policy, and any other terms and conditions regarding the Services that Shark Contractors and the User may have mutually agreed upon are all included in the term "Agreement."
Any law, regulation, subordinate law, ordinance, rule, judgment, rule of law, order (interim or final), writ, decree, clearance, authorizations, approval, directive, circular guideline, policy, requirement, code of practice, or guidance note, or other governmental, regulatory, statutory, administrative restriction or any similar form of decision, determination, or interpretation or administration of any of the foregoing by any statutory or regulatory authority or government agency or any other authority, each of which has jurisdiction over the subject
Brokers include property dealers, brokers, middlemen by any name, and real estate agents as defined by the Real Estate (Regulation and Development) Act of 2016. They also include property brokers, channel partners, sales agencies, and other third parties who negotiate or act on behalf of one person in a transaction of transfer, including sale, purchase, leave, license, lease, or such other form of transfer in relation to a plot, apartment, or building, as the case may be, including marketing and promotion of such plot, apartment, or building,
Any computer program, instruction, data, or instruction that attaches itself to another computer resource and operates when a program, instruction, or other event occurs in that computer resource or that destroys, damages, degrades, or adversely affects the performance of a computer resource is considered a computer virus.
Shark Contractors 's assets, business processes, methods, policies, subscription plans, publications, documents, research, operations, services, strategies, techniques, agreements, contracts, terms of agreements, transactions, potential transactions, negotiations, pending negotiations, know-how, trade secrets, computer programs, computer software, applications, operating systems, software design, web design, work-in-process databases, manuals, records, articles, systems, material, sources of material, supplier identity and information, vendor identity and information, User identity and information, financial information
The term "content" refers to and encompasses all data and information on the Site.
Any entity exercising executive, legislative, judicial, regulatory, or administrative functions of or pertaining to the government, as well as any other government authority, agency, department, board, commission, or instrumentality or political subdivision thereof, as well as any court, tribunal, or arbitrator(s) of competent jurisdiction, as well as any Government or non-Government self-regulatory organization, agency, or authority, is considered a Government Authority. having jurisdiction over the Services envisioned by the Agreement and the Agreement itself.
The Information Technology Act of 2000 is referred to as the "IT Act."
Patents, inventions, know-how, trade secrets, trademarks, service marks, designs, tools, devices, models, procedures, processes, systems, principles, algorithms, works of authorship, flowcharts, drawings, and other confidential and proprietary information, data, documents, instruction manuals, records, memoranda, notes, user guides, ideas, concepts, information, materials, discoveries, developments, and other copyrightable works, and techniques in either printed or machine-readable form, regardless of whether they are copyright
All rights, titles, and interests under the Patents Act of 1970, the Trademarks Act of 1999, and the Copyright Act of 1957, respectively, are referred to as Intellectual Property Rights. any common law or statute, including patent rights; moral rights as well as copyrights; and any similar rights to intellectual property that exist anywhere in the world, regardless of whether they are negotiable; ( b) any associated licenses, permissions, or grants; ( c) the ability to apply for any of the aforementioned positions and the right to do so from anywhere in the world; d) the right to obtain and maintain appropriate intellectual property registrations; e) all of its renewals and extensions; f) causes of action that are related to it, including the right to sue for and recover damages and profits that are due or accrued as a result of past, present, or future infringements or violations of it; ( g) any information that is proprietary.
Shark Contractors refers to and encompasses Shark Contractors Technologies Solutions Private Limited, a company incorporated under the Companies Act, 2013, its officers, directors, employees, and representatives, as well as its Site.
The term "privacy policy" refers to and encompasses the Shark Contractors privacy policy, which is specifically outlined in Section II.
The User's use of the Service in violation of the Agreement and applicable law is considered Prohibited Conduct; the infringement of third party rights or the aiding of their infringement; infringement or misappropriation of the Intellectual Property Rights of Shark Contractors or any other individual; attempt to gain or assist another user in gaining unauthorized access to the Site, Services, or any systems or networks connected to them; "frame" or "mirror" any content on any other server, wireless device, or Internet-based device, or create internet links to the Site; sending unsolicited, duplicate, or spam messages use or storage of material that is obscene, threatening, libellous, or otherwise illegal or tortious, such as material that harms children or violates the privacy rights of third parties, causing harassment, annoyance, anxiety, or inconvenience to anyone; modify or create derivative works based on the Service, as well as impersonation, claiming a false affiliation, accessing another account without permission, and misrepresenting user information.
The mobile number, e-mail address, username, and any other details or information provided by the user during the initial application and subscription are all considered to be Registration Data.
The terms "Personal Information" and "Aadhaar Card," "PAN Card," and "biometrics," as well as "financial information" such as "bank account," "debit card," and "credit card" details, as well as other "sensitive information" about the user or the person in question that can be used to personally identify that user or that person, are all examples of personal information.
Shark Contractors 's services to users of the site in India include: (a) connecting tenants and owners to find each other without paying any brokerage; (b) providing services to users who want to post their listings for the purposes of renting their property; (c) providing services to users who want to secure/buy a property through the site; and (d) providing services to users pertaining to the processing of paperwork and documentation, relating to lease agreement registration, bank franking, police verification, and society approvals with regard to the e) services for people who want to advertise their products or services on the site by purchasing advertising space, f) services for people who want to receive promotional messages and advertisements on the site and via e-mail and text message, g) a building-specific network for residents to interact with neighbors and share neighborhood information, h) services for people who want to pay rent to other people on the site through third-party payment gateways, and i) connecting people to other related service providers.
Shark Contractors Technologies Solutions Private Limited owns, operates, and manages the websites www.Shark Contractors .in (www.Shark Contractors .com), www.Shark Contractors hood.com, and www.Shark Contractors .com. Site also includes the mobile application owned, operated, and managed by Shark Contractors Technologies Solutions Private Limited.
Any third-party service provider with whom Shark Contractors has an agreement to provide services in addition to the Services to the User is included in the definition of "Terms and Conditions," which includes the terms and conditions outlined in Section I of the Agreement.
Any person who uses the Site to host, publish, share, transact, display, or upload information or views, whether as a tenant or an owner looking for potential tenants, is considered a user. Other people who use the Site together are also considered users.
Registration Data, Personal Information, and any other data, details, or information pertaining to the User that the User provides to Shark Contractors in relation to the Services, whether through the Site, e-mail, or any other communication method agreed to by the User and Shark Contractors , constitute User Information.
INTERPRETATION Unless the context specifies otherwise or there is a contrary indication,
(a) Any reference to a statutory provision includes any subsequent subordinate legislation enacted under that provision, and any reference to any such legislation or law includes any such legislation or law as it may from time to time be amended, supplemented, or re-enacted.
b. Any individual, corporation, partnership, unincorporated organization, or government agency is referred to in this Agreement as well as their respective successors and permitted assigns. Individuals are referred to as their legal representatives, administrators, executors, and heirs, and trusts are referred to as the trustee or trustees for the time being.
c) Headings to Sections and Clauses are only for convenience and will not be considered when interpreting those sections and clauses.
d) Words implying a particular gender include all genders, and the singular includes the plural and vice versa.
e. The terms "other," "otherwise," and "whatsoever" shall not be construed as limiting the generality of any of the preceding words or of any matters specifically referred to.
Acceptance of the Terms and Conditions i. Acceptance of the Terms and Conditions and Privacy Policy constitutes the Agreement between the User and Shark Contractors , which shall deem to replace all previous arrangements between the User and Shark Contractors in relation to the Services and access to the Site. Shark Contractors agrees to provide to the User the Services in accordance with and on the basis of this Agreement.
Each time the User accesses the Site and completes the registration process iii, the User agrees to be bound by the Agreement. The user warrants to Shark Contractors that they are at least 18 years old and capable of entering into, carrying out, and observing the terms of the agreement. Only with the involvement, guidance, supervision, and/or prior consent of their parents or legal guardians, through the Account of such parent or legal guardian, may individuals under the age of 18 (eighteen) access the Site or a Service. It is not the responsibility of Shark Contractors to determine whether a user is at least 18 years old.
4. ACCESS TO THE SITE i. The Site can be accessed by first-time users for exploratory browsing without the need to create an Account.
ii. In order to access the Services and retrieve specific information, the User undertakes and agrees to provide User Information, upload Content, and establish an Account.
iii. The User's one-time password is not required for the Account to be verified by the Broker. A mobile number can only be used once to create an Account, according to the User's undertaking and agreement. Shark Contractors reserves the right to carry out the necessary verification in the event that it determines that a user has created multiple accounts and will take the necessary action.
iv. When it comes to gaining access to the Site, the user agrees to work with any Shark Contractors employees who may be necessary.
5. SUBSCRIPTION PLANS i. Subject to the user's requirements and subject to payment of applicable fees, Shark Contractors provides a bundle of services to which the user can subscribe.
ii. Except when the user selects the Moneyback Plan as described on the Site, the subscription fee paid by the user cannot be refunded.
iii. Shark Contractors reserves the right to change the price of any subscription plan at any time—before, during, or after the user signs up for the plan—without notifying the user. The user agrees to pay the difference after the fees have been revised, and Shark Contractors will notify the user of the new fees.
6. User Information i. Shark Contractors is not responsible for the User Information's accuracy, quality, integrity, legality, reliability, appropriateness, or intellectual property rights.
ii. The deletion, correction, destruction, damage, loss, or failure to store any User Information, in whole or in part, is beyond Shark Contractors 's control.
iii. In its sole discretion, Shark Contractors reserves the right to withhold access to, remove, or discard any User Information from the Site—whole or in part.
iv. Any User Information that is made available to Shark Contractors through the Site or in any other way can be verified by Shark Contractors , but it is not required to do so. Shark Contractors also has the right but not the obligation to keep or forward any User Information.
7. Rights of Shark Contractors i. Shark Contractors reserves the right to reject or disable an account at any time for any reason related to the safe and secure operation of the Site, including but not limited to the user's violation of any applicable law or anything done in violation of this Agreement.
ii. Shark Contractors has internal infrastructure for conducting a background check and verifying the User Information and Account, subject to applicable law, to ensure that Brokers are not self-registering on the Site. Shark Contractors reserves the right to reject or disable an account without explanation if a user is found to be a Broker.
iii. At any time, and without prior notice to the user, Shark Contractors reserves the right to modify, suspend, or terminate all or any part of the Services, including their features, structure, fees, and layout, as well as the user's account and access to the site.
iv. Any time the site is down for maintenance, upgrades, testing, or for any other reason that Shark Contractors deems appropriate, Shark Contractors will make every effort to notify the user in advance, but Shark Contractors is under no obligation to do so. This includes when the site is being deactivated for repairs, inspection, or testing by a government agency. In the event of a disruption or error on the Site, Shark Contractors will do everything in its power to restore normal service.
v. Shark Contractors is free to send the user notifications, confirmations, and other communications via the Site, e-mail, text message, or any other method the user specifies, and/or to send the user promotional or other relevant information regarding the Services. Unless the users have chosen not to receive these e-mails, Shark Contractors may also occasionally send bulletins to users via email. These emails may also include information about the neighborhood, advice, or any other offer from a third party. The legitimacy of any of these offers is not the responsibility of Shark Contractors . By sending an email to hello@Shark Contractors .in, users can unsubscribe at any time from receiving such notifications or promotional materials.
